Abstract

The subject of the commentary is the judgment of the Supreme Court of 30 May 2023 (II KK 631/22) overturning the judgment of the appellate court. The author agrees with the view of the Supreme Court and focuses on the interpretative problem concerning two elements of crime, i.e., the significant effects and extent. A distinction is made between these two concepts. The proposed interpretation is based on views held by the legal scholars. The author uses the criterion of how the message is received. The conclusions state the variety of possible effects of incitement to crime, which should be examined in concreto.
