Abstract
The paper addresses the issue of transferring persons deprived of their liberty under the provisions of the Convention on the Transfer of Sentenced Persons. It presents conditions for transfer and possible procedures of enforcing the sentence. The paper concentrates on the most interesting and controversial issue: the conditional release from serving the remainder of the penalty. If a term of parole is determined in the sentence issued by the sentencing State, it individualizes the penalty and therefore is binding for the court of administering State.
